Terms of Service

1. Acceptance of Terms

By accessing and using Moklo's AI Sales Agent platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Service Description

Moklo provides an AI-powered sales automation platform that enables businesses to conduct outbound sales activities including SMS, RVM (Ringless Voicemail), and AI-driven conversations. The Service includes lead generation, conversation management, and CRM integration capabilities.

3. Trial Period Terms and Conditions

3.1 $0 Trial Plan

When you sign up for the $0 Trial Plan, you agree to the following terms:

Trial Activation: You may start using the Service for $0 today. Your subscription will convert to a paid subscription at $799/month if and only if:

  1. Your AI SDR produces real conversations within 72 hours, AND
  2. You complete ALL of the required steps listed below

3.2 Required Steps to Maintain Free Trial

To keep your trial free and avoid the $799 activation fee, you MUST complete ALL of the following steps within the specified timeframes:

  1. Approve AI SDR Settings (Within 24 Hours): You must review and approve your AI Sales Development Representative settings within 24 hours of account creation. This includes voice selection, messaging templates, and campaign parameters.
  2. Provide Outbound Records (Within 24 Hours): You must provide at least 5,000 outbound contact records within 24 hours of account creation. Records may be purchased through our platform or uploaded directly from your existing database.
  3. Respond to Interested Leads (Within 1 Hour): You must respond to any interested leads generated by the AI SDR within 1 hour of notification and submit feedback on the lead quality through our platform.
  4. Continuous Operation (Full 72 Hours): You must allow the system to run continuously for the full 72-hour test period without pausing, stopping, or modifying core campaign settings.

⚠️ IMPORTANT: Activation Fee

If ANY of the above steps is not completed within the specified timeframe, your payment method will be automatically charged the $799 activation fee, and your subscription will begin at $799/month.

3.3 Trial Success Criteria

A "real conversation" is defined as:

  • A two-way exchange between the AI SDR and a prospect
  • Minimum of 3 messages exchanged
  • Prospect demonstrates interest in your product or service
  • Conversation logged and tracked in the Moklo dashboard

3.4 Trial Accountability

These requirements ensure accountability, encourage active participation, and promote fair use of the trial period. By requiring users to complete specific actions, we ensure that trial participants are genuinely evaluating the Service and not abusing the free trial offer.

3.5 Cancellation During Trial

You may cancel your trial at any time before the 72-hour period ends. However, if you have not completed all required steps, the $799 activation fee will still apply. To avoid any charges, you must cancel AND ensure all required steps remain incomplete.

4. Fast-Action Activation Plan

The Fast-Action Activation Plan is available at $499/month with immediate activation. This plan includes:

  • Immediate access to all platform features
  • 10,000 included credits
  • +2,500 FREE bonus credits
  • DFY (Done-For-You) A2P Verification
  • Locked-in discounted rate (no price increases)
  • AI Performance Tuning Session
  • AI Campaign Starter Pack
  • Double Data Matching (5,000 records + 1,000 free record match boost)

This plan does not have a 72-hour requirement and billing begins immediately upon activation.

5. Payment Terms

By providing payment information, you authorize Moklo to charge your payment method for all fees incurred under your account. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

Subscription fees are billed monthly in advance. If payment fails, we reserve the right to suspend or terminate your access to the Service.

6. Acceptable Use Policy

You agree to use the Service in compliance with all applicable laws and regulations, including but not limited to:

  • TCPA (Telephone Consumer Protection Act) compliance
  • CAN-SPAM Act compliance
  • GDPR and data privacy regulations
  • 10DLC and A2P messaging regulations

You are solely responsible for obtaining proper consent from contacts before initiating outbound communications.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect, use, and protect your data as described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

The Service, including all software, algorithms, AI models, and content, is owned by Moklo and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes only.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOKLO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease, and any outstanding fees will become immediately due and payable. Moklo reserves the right to terminate accounts that violate these Terms or engage in fraudulent activity.

11. Changes to Terms

Moklo reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
